Welcome to TechYz Software Solutions Pvt Ltd (“TechYz”, “we”, “our”, or “us”). These Terms & Conditions (“Terms”) govern your use of our SaaS products, hardware, and related services (“Services”).
By using our Services, you agree to these Terms and our Privacy Policy, which forms an integral part of this agreement.
1. Acceptance of Terms
- You are at least 18 years old or legally eligible
- You agree to these Terms and Privacy Policy
- You can bind your organization (if applicable)
2. Services Provided
- SaaS: Subscription-based software
- Hardware: Devices and equipment
- Support: Training and technical assistance
3. Data Protection & Privacy
We collect and process data as described in our Privacy Policy, including:
- Personal Information (name, email, phone, etc.)
- Health Information (fitness, medical data with consent)
- Usage and device data
Processing is based on:
- Consent (especially for health data)
- Contractual necessity
- Legal obligations
- Legitimate business interests
For white-label clients:
- You act as the data controller for your end users
- You must provide your own privacy policy
- You are responsible for legal compliance with your users
4. Data Retention & Deletion
- Account Data: Retained during active use + up to 3 years
- Health Data: Deleted within 12 months of inactivity
- Transaction Data: Retained up to 8 years (legal requirement)
- Usage Data: Retained 12–24 months
User deletion requests are processed within 7–30 days, including reasonable efforts to remove backup data.
Upon termination of Services, data may be retained for up to 30–90 days before permanent deletion.
5. Payment Terms
Subscriptions:
- Recurring billing (monthly/annual)
- Auto-renewal applies
- No partial refunds unless required by law
- Non-payment may result in suspension
Hardware:
- Full payment required
- Risk transfers upon delivery
Payments & Third Parties:
- Payments are processed by secure third-party providers
- We do not store full payment details
6. Cancellations & Refunds
Refunds are governed by our Refund Policy. By using our Services, you agree to that policy.
7. Acceptable Use
- No illegal or harmful activities
- No reverse engineering or resale
- No IP violations or misuse
8. Intellectual Property
All rights remain with TechYz. You receive a limited license during subscription.
9. Service Availability
Services are provided “as is” without guaranteed uptime unless specified in a written SLA.
10. Data Security & Breach
We use reasonable safeguards to protect data. In case of a data breach, we will notify users and authorities as required by law.
11. Data Storage & Backup Disclaimer
We do not guarantee backup or recovery unless explicitly agreed. Users are encouraged to maintain independent backups.
12. Warranties (Hardware)
- Manufacturer warranties may apply
- Excludes misuse or damage
13. Limitation of Liability
- No liability for indirect or consequential damages
- Maximum liability limited to fees paid in last 12 months
14. Indemnification
You agree to indemnify TechYz against claims arising from misuse, legal violations, or third-party disputes.
15. App Store Compliance
You agree to comply with applicable platform policies (Google Play / Apple App Store).
16. Export Compliance
You must comply with applicable export and trade laws.
17. Termination

- Misuse of Services
Access ends immediately upon termination. Key clauses survive termination.
18. Force Majeure
We are not liable for events beyond our control (natural disasters, outages, etc.).
19. Governing Law
Governed by Indian law. Jurisdiction: Thiruvananthapuram, Kerala.
20. Modifications
We may update Terms anytime. Continued use means acceptance.
